ET is actualy pretty smart about that. If a file with the same name, but a different checksum exists, it creates filename.checksum.pk3 and uses that.
Hopefully nobody will use the md5tool on 3.2.1 then.

Am I right in saying that an MD5Tool kick can occur when someone has a hack fo some kind on their computer but not actually installed?

It simply reads files on the HDD and performs a MD5 hash on a small part of it. In other words it can be used to test if [a small part of] certain files are unaltered or if known cheat files are present, but is completely unaware of whether any file is in use or not.

When checking for known cheats it actually only checks the filename, so having an empty textfile named "whatevertheserveradminthinksisacheat.txt" in etmain is as bad as having the actual cheat (from the server's pov).
